# Décret n° 2005-481 du 16 décembre 2005 modifiant et complétant certaines dispositions du décret n° 76-165 du 27 avril 1976 fixant les conditions d'obtention du titre foncier

Vu la Constitution ; Vu l'ordonnance n° 74-1 du 6 juillet 1974 fixant le régime foncier ; Vu le décret n° 76-165 du 27 avril 1976 fixant les conditions d'obtention du titre foncier ; Vu le décret n° 2004-320 du 8 décembre 2004 portant organisation du Gouvernement ,
# Décrète :
Article premier.- Les dispositions des articles 2, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 23, 29, 31, 34, 35, 37, 39, 41 et 43 du décret n° 76-165 du 27 avril 1976 fixant les conditions d'obtention du titre foncier, sont modifiées et complétées ainsi qu'il suit :
Article 2. (nouveau).- (1) Toute personne dont les droits ont été lésés par suite d'une immatriculation, n'a pas de recours sur l'immeuble, mais seulement en cas de dol, une action personnelle en dommages-intérêts contre l'auteur du dol.
(2) L'action est portée devant la juridiction civile du lieu de situation de l'immeuble. (3) Toutefois, le ministre chargé des Affaires foncières peut, en cas de faute de l'administration, résultant notamment d'une irrégularité commise au cours de la procédure d'obtention du titre foncier, et au vu des actes authentiques produits, procéder au retrait du titre foncier irrégulièrement délivré. (4) Le retrait du titre foncier délivré entraîne la mutation sans frais dudit titre au nom du

# Decree No. 2005/481 of 16 December 2005 to amend and supplement some provisions of Decree No. 76/165 of 27 April 1976 to establish the conditions for obtaining land certificates

Mindful of the Constitution; Mindful of Ordinance No. 74/1 of 6 July 1974 to establish rules governing land tenure; Mindful of Decree No. 76/165 of 27 April 1976 to establish the conditions for obtaining land certificates; Mindful of Decree No. 2004/320 of 8 December 2004 to organize the Government,
# Hereby decrees as follows:
1 The provisions of Article 2, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 23, 29, 31, 34, 35, 37, 39, 41 and 43 of Decree No. 76/165 of 27 April 1976 to establish the conditions for obtaining land certificates are amended and supplemented as follows: 2. (new)(1) Any person whose rights have been encroached upon in consequence of a registration shall have no claim on the property; in the sole event of fraud, he shall take personal action for damages against the perpetrator thereof. (2) The action shall be brought before the civil court of the area where the property is situated.
