Establishment, organisation, functioning of the Specialized Corps of Judicial Police Officers of the Special Criminal Court.-
# THE PRESIDENT OF THE REPUBLIC,
Mindful of the Constitution;
Mindful of Law n° 2005/07 of 27 July 2005 t institute the Criminal Procedure Coe;
Mindful of Law n° 2011/27 of 14 December 201T to amend-and supplement certain provisions of Law nº 2006/15 of 29 December 2006 to organize the Judiciary;
Mindful of Law nº 2011/28 of 14 December 2011 to set up a Special Criminal Court:
Mindful of Decree nº 2001/181 of 25 July 2001 to organize the National Gendarmerie;
Mindful of Decree n° 2011/412 of 09 December 2011 to organize the Presidency of the Republic of Cameroon;
Mindful of Decree n° 2012/223 of 15 May 2012 relating to the administrative set-up of the Special Criminal Court;
Mindful of Decree nº 2012/540 du 19 November 2012 to organize the General Delegation for National Security,
# HEREBY DECREES AS FOLLOWS:
# CHAPTER I:
# ESTABLISHMENT, ORGANIZATION AND FUNCTIONING
Article 1: A specialized Corps of Judicial Police Officers of the Special Criminal Court, herein under referred to as the "Corps", is hereby established.
Article 2: Based at the Headquarters of the Special Criminal Court, the corps shall have countrywide jurisdiction jurisdiction.
Article 3: Under the supervision and control of the Procureur general of the Special Criminal Court, the Corps shall be responsible for:
- Conducting investigations concerning the embezzlement of public funds and related offences whcre the loss amounts to at least 50 000 000 (fifty million) CFA francs.
- Executing Court warrants and rogatory commissions failing within the jurisdiction of the Special Criminal Court.
Article 4: (1) on the instructions of the Procureur General of the Special Criminal Court, the Corps shall conduct investigations in accordance with the provisions of the Criminal Procedure Code.
(2) 'The investigation reports shall be forwarded to the Procureur General of the Special Criminal Court. (3) To perform their duties, Judicial Police Officers may require the assistance of experts.
Article 5: Any offer to restitute the corpus delicti in cash or in kind in the course of the preliminary investigation shall be recorded in the report forwarded to the Procureur General of the Special Criminal Court.
Article 6: The Corps shall comprise:
- An investigations Division,
- Administrative Services.
Article 7: (1) The Investigations Division shall be composed of:
- a Division Head:
- a Deputy Division Head;
- Research Officers.
(Under the supervision and control of the Procureur General of the Special Criminal Court, the Division head shall be responsible for:
- conducting investigations;
- coordinating the various activities of the Corps;
- seeing the training and the retraining of Corps Personnel.
(3) The Deputy Division Head shall assist the Division head in the performance of his duties. (4) Research Officers shall be responsible for conducting investigations for cases assigned them by the Division Head.
