Résolution n°005 du 19 juin 2023 sur l'accès des avocats aux informations relatives aux finances du Barreau

La résolution du Conseil de l'Ordre du Barreau du Cameroun encadre l'accès des avocats aux informations sur les finances du Barreau. Elle interdit toute publication des comptes hors du Barreau et réserve l'accès aux avocats à jour de leurs obligations professionnelles. Les avocats souhaitant consulter les comptes doivent adresser une demande écrite au Trésorier au moins 72 heures à l'avance. RESOLUTION N°005 OF JUNE 19, 2023, ON ACCESS TO INFORMATION ON THE BAR'S FINANCES BY ADVOCATES

THE YEAR TWO THOUSAND AND TWENTY-THREE AND THE NINETEENTH DAY OF JUNE

THE BAR COUNCIL OF THE CAMEROON BAR ASSOCIATION MEETING IN A JOINT SESSION,

COMPOSED OF:

MINDFUL of Law No. 90/059 of December 19, 1990 to Organize Practice at the Bar;

MINDFUL of Article 60 of the Internal Regulations of the Cameroon Bar Association and the mandatory provisions relating to absolute respect for professional secrecy and the core principles of the Advocate's Oath;

MINDFUL of the minutes of the joint session of the Bar Council held on June 19, 2023 in Yaoundé;

Considering that the transparency of the Bar's accounts is a fundamental requirement for trust between Advocates and the professional body that represents them;

Considering that the Bar's finances are derived essentially from dues paid by Advocates;

Considering the need to reconcile the confidentiality of the Bar's accounts with respect to third parties, and the need to inform Advocates about the management of their financial and moral interests;

HEREBY DECIDES:

Article 1: Any publication of the Bar's accounts anywhere other than within the Bar is prohibited.

Article 2: Any Advocate who is up to date with his or her professional obligations can have access to information on the Bar's statement of accounts.

Article 3: The statement of accounts as prescribed by law, shall contain the detailed annual report for the previous year and the provisional budget for the current year.

Article 4: Advocates wishing to consult the Bar's accounts must send a written request to the Bar Treasurer at least 72 hours before the date envisaged for consultation.

The Treasurer shall take all necessary steps to facilitate consultation of the requested accounting documents by the Advocate.

Article 5: The accounting documents requested shall be made available to the requesting Advocate by the Bar accountant on the requested date determined by the Bar Treasurer.

Article 6: Under no circumstances, shall an Advocate reproduce the said documents, nor communicate to non-advocates or third parties any information of which he or she is aware, on penalty of disciplinary proceedings.
