To commute and remit sentences
THE PRESIDENT OF THE REPUBLIC
Mindful of the Constitution;
Mindful of law n°67/LF. 1 of 12 June 1967 to institute the Penal Code and subsequent amendments thereto;
Mindful of law n°82/14 of 26 November 1982 to lay down the organization and functioning of the Higher Judicial Council.
HEREBY DECREES AS FOLLOWS:
Article 1 Persons whose sentences have become final as at the date of signature of this decree shall benefit from remission as follows:
- Commutation of the death sentence to life imprisonment in favor of persons initially sentenced to death;
- Commutation to 20 (twenty) years in favor of persons initially sentenced to death and whose sentence has already been commuted to life imprisonment;
- Commutation to 20 (twenty) years in favor of persons initially sentenced to life imprisonment that has not yet been commuted;
- Commutation to 25 (twenty five) years imprisonment in favor of persons initially sentenced to life imprisonment, for misappropriation of public funds and whose stay in prison is equal to or above 10 (ten) years;
- Total remission of sentence in favor of persons initially sentenced to a term of imprisonment, for misappropriation of public funds, and whose stay in prison for the same offence is above 10 (ten) years;
- Remission of 10 (ten) years imprisonment in favor of persons initially sentenced to a term of imprisonment, for misappropriation of public funds, and whose stay in prison is below 10 (ten) years;
- Remission of 03 (three) years in favor persons initially sentenced to death and whose sentence has already been commuted to a term of imprisonment;
- Remission of 03 (three) years in favor persons initially sentenced to life imprisonment that has already been commuted to a term of imprisonment;
- Remission of 03 (three) years in favor persons initially sentenced to life imprisonment that has already been commuted to a term of imprisonment equal to or above 10 (ten) years;
- Remission of 15 (fifteen) months in favor persons initially sentenced to a term of imprisonment below 10 (ten) years but above 05 (five) years;
- Remission of 12 (twelve) months in favor persons initially sentenced to a term of imprisonment below 05 (five) years but above 03 (three) years;
- Remission of 08 (eight) months in favor persons initially sentenced to a term of imprisonment below or equal to 03 (three) years but above 01 (one) year;
- Remission of 06 (six) months in favor persons initially sentenced to a term of imprisonment below or equal to 01 (one) year.

Article 2: For the application of the remission provided hereinabove, minors whithin the meaning of criminal law who have been sentenced shall in addition benefit from one third of the applicable remission;
