# CONTEXT AND JUSTIFICATION

It's almost thirty (30) years since the founding treaty of the Organization for the Harmonization of Business Law in Africa (OHADA) was signed on October 17, 1993 in Port-Louis (Mauritius), and revised on October 17, 2008 in Quebec (Canada). Over the years, OHADA has established its identity and stood out worldwide as an original model of legal integration. By constantly striving for the establishment of modern business law, appropriate and common to all its member states, the organization contributes to legal and judicial security, to the improvement of the investment climate and to the economic development of Africa.
To fulfill its mission, OHADA has been endowed with a homogeneous institutional nomenclature. Alongside the Conference of Heads of State and Government and the Council of Ministers, there are three day-to-day operational institutions (the Permanent Secretariat, the Common Court of Justice and Arbitration - CCJA and the Higher Regional School of Magistracy - ERSUMA) and support bodies such as the Accounting Standards Commission (CNPC), the Technical Committee for the Standardization of Electronic Procedures (CTN) and the OHADA National Commissions (CNO) which, in addition to their daily national activities, support the Committee of Experts responsible for the technical preparation of meetings of the Council of Ministers.

OHADA's experience of legal integration is often described as a success story. Its normative activity has given rise to various regulations and, above all, to the eleven (11) "Uniform Acts" listed below, of which only the latest, adopted in December 2022, has not yet come into force:
- The uniform act on general commercial law, adopted on April 17, 1997 in Cotonou (Benin) and revised on December 15, 2010 in Lomé (Togo);
- The uniform act on commercial companies and economic interest groups, adopted on April 17, 1997 in Cotonou (Benin), revised on January 30, 2014 in Ouagadougou (Burkina Faso);
- The uniform act on the organization of securities, adopted on April 17, 1997 in Cotonou (Benin) and revised on December 15, 2010 in Lomé (Togo);
- The uniform act organizing simplified debt recovery and enforcement procedures, adopted on April 10, 1998 in Libreville (Gabon);
- The uniform act relating to the organization of collective procedures for the settlement of debts, adopted on April 10, 1998 in Libreville (Gabon), and revised on September 10, 2015 in Grand-Bassam (Côte d'Ivoire);
