Mindful of Law No. 92/7 of 14 August 1992 to institute the Labour Code; Mindful of Law No. 2019/24 of 24 December 2019 to institute the General Code of Regional and Local Authorities; Mindful of Decree No. 78/484 of 9 November 1978 to lay down common provisions applicable to State employees governed by the Labour Code, as amended and supplemented by Decree No. 82/100 of 3 March 1982; Mindful of Decree No. 2011/408 of 9 December 2011 to organize the Government, as amended and supplemented by Decree No. 2018/190 of 2 March 2018; Mindful of Decree No. 2018/191 of 2 March 2018 to reorganize the Government; Mindful of Decree No. 2018/449 of 1 August 2018 to organize the Ministry of Decentralization and Local Development; Mindful of Decree No. 2022/354 of 9 August 2022 to lay down conditions for exercising municipal policing, Mindful of Order No. /A/MINDDEVEL of on the code of ethics for officers in charge of municipal policing,
HEREBY ORDERS AS FOLLOWS:
CHAPTER I GENERAL PROVISIONS
ARTICLE 1: This order, issued pursuant to Article 19 of the aforementioned Decree No. 2022/354 of 9 August 2022, defines conditions for the swearing in of some municipal police officers.
CHAPTER II SWEARING IN CONDITIONS
ARTICLE 2: (1) The municipal police officers referred to in Article 3 below shall be judicial police officers with special powers.
(2) Before assuming office, they shall take oath before the Court of First Instance with territorial jurisdiction.
ARTICLE 3: The following municipal police officers shall be authorized to take oath:
- the head of the municipal police service;
- heads of section; and
- staff belonging to category 6 at least.
ARTICLE 4: (1) The mayor or city mayor shall prepare a file requesting the competent court of first instance to organize the swearing-in of municipal police officers eligible to take oath.
(2) The file referred to in paragraph 1 above shall comprise:
- a stamped application addressed to the President of the Court;
- a copy of the approved deliberation to establish a municipal police service; and
- the personal file of each of the candidate employees to take oath.
ARTICLE 5: The personal file of an employee referred to in Article 4 (2) above shall comprise the following documents:
- a certified true copy of the certificate;
- a copy of the certificate issued by the National School of Local Administration (NASLA);
- a copy of the appointment instrument for the head of service or head of section;
- a certificate of non-conviction issued not more than three (3) months ago;
- a copy of the national identity card;
- a copy of the recruitment instrument.
